REGULATIONS OF THE Rusak Business Services NEWSLETTER
1 General provisions
1.1 These regulations constitute the basis for the provision of the newsletter service by Rusak Business Services Sp. z o.o. with headquarters in Warsaw, ul. Odlewnicza 6, 03-231 Warszawa, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Of Warsaw in Warsaw, XIII Commercial Division of the National Court Register, under the number KRS 0000086532, NIP: 1130080883, REGON: 010466179, contact e-mail address: rusak@rusak.pl (hereinafter referred to as: „Administrator”).
1.2 The newsletter service consists in delivering registered users (hereinafter: „Users”), via e-mail, to the User’s address provided as part of the registration procedure, current information from the customs industry and international trade created by the Administrator (hereinafter: „Newsletter”).
1.3 Newsletter Service is provided via the website of the Get Response platform www.getresponse.pl (hereinafter referred to as: „Website”).
1.4 The Newsletter service is provided free of charge for an indefinite period.
2 Registration and use of the Newsletter service
2.1 Registration for the Newsletter service means acceptance by The user of these regulations and the privacy policy which is its integral part available at https://rusak.pl/polityka_prywatnosci (hereinafter: „Privacy Policy”)
2.2 To register for the Newsletter service:
2.2.1 complete the registration form available on the Website by providing the e-mail address, name and surname that the User represents;
2.2.2 check the box „Sign up now”;
2.2.3 the performance of the above means consent to receive the Newsletter as commercial information to the e-mail address provided by the User within the meaning of the Act of 18 July 2002 on the provision of electronic services (Journal Of Laws of 2017, item 1219, consolidated text and acceptance of these regulations and privacy policy
2.3 Expressing the consent referred to in point
2.2.3 above is completely voluntary – however, it is also necessary to use the Newsletter service. Failure to express this consent will result in the fact that the Newsletter service cannot be provided.
2.4 By registering for the Newsletter service in accordance with the procedure indicated in point 2.3 above, the User’s e-mail address will be added to the e-mail list. The User’s e-mail address will be used to send the User Newsletters.
2.5 To use the Newsletter service, it is necessary to:
2.5.1 have the following devices: a computer, laptop or other multimedia device with Internet access;
2.5.2 access to e-mail.
2.6 The administrator does not provide the devices referred to in point 2.5.1 above, browsers or internet access.
2.7 The User may at any time and without giving any reason resign from the Newsletter service. Such a request should be reported to the Administrator, e.g. via e-mail to the following address: rusak@rusak.pl or in writing to the following address: Rusak Business Services sp.z o.o. ul. Odlewnicza 6, 03-231 Warsaw. The template of the declaration of resignation from the Newsletter service constitutes an attachment to these regulations – the use of it is not necessary.
2.8 Moreover, the User may at any time and without giving any reason cancel the Newsletter service by clicking on the „unsubscribe” link in the footer of each Newsletter.
2.9 The Administrator reserves the right to stop providing the Newsletter service at any time. The Administrator will inform the User about the cessation of the Newsletter service to the e-mail address provided as part of the Newsletter subscription procedure.
3 Rules for using the Newsletter service
3.1 The User is obliged to provide true data when registering for the Newsletter service and when using it. The User is obliged to update the data in the event that they change.
3.2 The User undertakes to use the Newsletter service in accordance with the law and the principles set out in these regulations. It is forbidden for the User to provide illegal content, violate the law or decency.
3.3 The User undertakes not to take any action that would in any way interfere with the functioning of the Newsletter service, the Website or its elements, including in particular the obligation to refrain from any interference with the content. The Website or its technical elements.
3.4 The Administrator is authorized to make any changes to the Newsletter service, as well as to cease, permanently or periodically, the provision of the service without giving a reason.
3.5 The Newsletter is covered by copyright or other rights of the Administrator or other persons.
4.Complaints
4.1 Complaints about the Newsletter service may be submitted by the User, for example:
4.1.1 in writing to the Administrator’s address: Rusak Business Services sp.z o.o. ul. Odlewnicza 6, 03-231 Warsaw;
4.1.2 via e-mail to the following address: rusak@rusak.pl
4.2 It is recommended that the complaint contain a description of the complaint, the User’s request and the User’s data. The requirements set out in the preceding sentence take the form of recommendations and do not affect the effectiveness of complaints submitted without the recommended description of the complaint.
4.3 The Administrator, within 14 days from the date of receipt of the complaint from the User, will respond to the complaint and notify the User about the further procedure.
5 Personal data
5.1 Personal data provided by Users as part of subscribing and using the Newsletter service are processed by the Administrator, i.e. Rusak Business Services sp.z o.o. with headquarters in Warsaw, ul. Odlewnicza 6, 03-231 Warszawa, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register, under the number KRS 0000086532, NIP: 1130080883, REGON: 010466179, contact e-mail address: rusak@rusak.pl (hereinafter referred to as: „Administrator”).
5.2 Providing personal data by the User is voluntary, but necessary for the Administrator to provide the Newsletter service. Failure to provide the data in question will result in the Newsletter service not being provided.
5.3 The User has the right to access their personal data and to correct and delete them, in accordance with applicable law.
5.4 Detailed provisions regarding the protection of the User’s personal data can be found in the Privacy Policy.
6 Amendments to these Regulations
6.1 The Administrator reserves the right to amend these Regulations for an important reason, in particular in the case of:
6.1.1 the necessity to adapt the regulations to legal provisions or decisions and judgments of courts or public authorities;
6.1.2 changes to the functionality of the Newsletter service or the Website;
6.1.3 changes to data, including names, addresses, identification numbers, included in the regulations;
6.1.4 improving the User service.
6.2 The User will be informed about the change of the regulations by sending a notification to the User’s e-mail address about the change of the regulations (together with a link to the changed regulations).
6.3 Before the date of entry into force of the amended regulations, the User may declare to the Administrator that he does not accept the amended regulations. The declaration of disagreement with the change of the regulations is tantamount to the User’s resignation from the Newsletter service.
6.4 In the event that the User does not submit the declaration referred to in point 6.3 above or resigns from the Newsletter service prior to the entry into force of the amended regulations, the amended regulations shall be binding on him.
7 Governing Law and Dispute Resolution
7.1 The law applicable to the contract for the provision of the Newsletter service concluded between the Administrator and the User on the terms specified in these regulations is Polish law.
7.2 Any disputes related to the conclusion or performance of the contract for the provision of the Newsletter service will be settled by the competent common courts in Poland.
7.3 The User who is a consumer has the option of using an out-of-court complaint and redress procedure – information on the rules of access to dispute resolution procedures can be found at the following address: http://www.uokik.gov.pl, in the tab „Amicable resolution of consumer disputes” . The consumer also has the right to use the EU ODR internet platform, used for online dispute resolution, available at: http://ec.europa.eu/consumers/odr/.
8 Final Provisions
8.1 In matters not covered by these regulations, generally applicable provisions of Polish law shall apply, in particular: the Act of April 23, 1964, the Civil Code (Journal of Laws of 2017, item 459, uniform text), the Act of May 30, 2014 of the year on consumer rights (Journal of Laws of 2017, item 683, consolidated text) and the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219, consolidated text).
8.2 The form of a declaration of resignation from the Newsletter service constitutes Appendix 1 to these Regulations and is an integral part thereof.
